End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you and Lizt for the use of the Lizt mobile application ("App").

1. License Grant

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal mobile device
• Use the App for personal, non-commercial purposes
• Access features according to your subscription tier (Free or Premium)

2. License Restrictions

You may NOT:

• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Remove copyright or proprietary notices
• Use the App for commercial purposes without permission
• Create derivative works based on the App
• Rent, lease, lend, or resell the App
• Use the App to violate any laws or third-party rights
• Interfere with or disrupt the App's functionality

3. Ownership

The App is licensed, not sold. Lizt retains all rights, title, and interest in:

• The Lizt application and all its components
• All intellectual property rights
• Trademarks, logos, and branding
• Proprietary AI models and algorithms
• App updates and new features

4. User Data and Privacy

Your use of the App is subject to our Privacy Policy, which explains:

• What data we collect
• How we use your information
• How we protect your data
• Your rights regarding your data

5. Subscription Terms

Free Tier

• Limited to 5 listings per month
• Basic AI features
• Standard support

Premium Subscription

• Unlimited listings
• AI photo enhancement
• Advanced analytics
• Priority support
• Auto-renews monthly or yearly
• Cancel anytime

6. Updates and Modifications

We may:

• Update the App to add features, fix bugs, or improve performance
• Require you to install updates to continue using the App
• Modify or discontinue features with or without notice
• Change subscription pricing with 30 days' notice

7. Termination

By You

You may terminate this license at any time by:

• Deleting the App from your device
• Cancelling your account

By Us

We may terminate your license if you:

• Violate this EULA or our Terms of Service
• Engage in fraudulent activity
• Abuse the service or other users

Upon termination, you must immediately stop using the App and delete it from all devices.

8. Disclaimer of Warranties

We disclaim all warranties, express or implied, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability
• Uninterrupted or error-free operation

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR:

• Direct, indirect, incidental, or consequential damages
• Loss of data, profits, or revenue
• Business interruption
• Device damage or malfunction
• Third-party claims

Our total liability shall not exceed the amount you paid us in the past 12 months.

10. Geographic Restrictions

The App is controlled from the United States. By using the App, you acknowledge:

• The App may not be available or appropriate for use in all locations
• You are responsible for compliance with local laws
• Some features may be restricted in certain jurisdictions

11. Export Control

The App is subject to export control laws. You agree not to:

• Export or re-export the App to prohibited countries
• Use the App in violation of export laws
• Transfer the App to sanctioned entities

12. Third-Party Services

The App may integrate with or link to third-party services. We are not responsible for:

• Third-party content or services
• Changes to third-party APIs
• Third-party privacy practices
• Availability of third-party services

13. Indemnification

You agree to indemnify Lizt from claims arising from:

• Your use of the App
• Your violation of this EULA
• Your violation of third-party rights
• Content you upload or share

14. Changes to this EULA

We may update this EULA at any time. Updates will be:

• Posted in the App
• Effective upon posting (unless stated otherwise)
• Communicated via email for material changes

Continued use of the App after changes constitutes acceptance.

15. Governing Law

This EULA is governed by:

16. App Store Terms

Apple App Store

If you downloaded the App from the Apple App Store:

• This EULA is between you and Lizt, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide support
• In case of failure to conform to warranty, you may notify Apple for a refund
• Apple is not liable for any claims related to the App
• You must comply with Apple's Terms of Service

Google Play Store

If you downloaded the App from Google Play:

• You must comply with Google Play's Terms of Service
• Google is a third-party beneficiary with enforcement rights
• This EULA is between you and Lizt, not Google

17. Accessibility

We strive to make the App accessible to all users. If you experience accessibility issues, contact us at support@lizt-app.com.

18. Severability

If any provision of this EULA is found invalid or unenforceable, the remaining provisions remain in full effect.

19. Entire Agreement

This EULA, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and Lizt regarding the App.
